WHAT IS A K-1 FIANCEE VISA PROCESS? 

​

Under existing U.S. Immigration policy, the fiancé(e) K-1 non-immigrant visa is for the foreign-citizen fiancé(e) of a U.S. citizen. The K-1 visa allows the foreign-citizen fiancé(e) to travel, enter the United States, and marry his or her U.S. citizen sponsor within 90 days of arrival.

For most engaged couples, the K-1 visa process proves to be the easiest route with the highest rate of success. Nearly 100% of the applications filed for this visa type are approved as long as it has been proven that the relationship is bonafide.

 

The marriage must be legally possible in accordance with the law in the United States where the marriage will take place.

After the marriage, the alien fiancé can proceed and apply for Adjustment of Status (AOS) to obtain legal permanent residency status with the relevant form I-485.

​

A K-1 Fiancé visa is a one-time visa entry into the United States so that the marriage ceremony may take place within the prescribed period by the provision.

BASIC REQUIREMENT

FOR THE K-1 VISA PROCESS

What are the basic requirements for a fiancée visa?

  • You, the Petitioner must be a US Citizen. Green card holders and legal permanent residents are not qualified to apply.

 

  • You, the US Citizen (Petitioner) and your Alien Fiancée (Beneficiary) must be legally able to marry. Any previous marriages from both parties must have been legally terminated by divorce, death, or annulment.

​

  • You, the US Citizen (Petitioner) and your Alien Fiancée (Beneficiary) must have met in person at least once within two years of filing the K-1 petition.

​

  • You, the US Citizen (Petitioner) and your Alien Fiancée (Beneficiary) must demonstrate bona fide evidence of your relationship and genuine intentions to marry each other within ninety (90) days upon arrival in the United States.

​

  • During the Interview at the local consulate, the Alien Fiancée (Beneficiary) must present a valid passport of at least six (6) months.

​

  • You, the US Citizen must show proof of adequate financial capability to support your Alien Fiancée. This will guarantee the government of the United States that the K-1 alien beneficiary will not become a public charge.
